Terms & Conditions

1. Definitions

  • "Agreement" means these Terms & Conditions, together with any booking confirmation.
  • "Service" means the sessions, courses and programmes offered by Pusaka Notes, including the First Fourteen Days Documents Session, the Bilingual Family Register Course and the Heritage Association Records Programme.
  • "User" or "you" means any person who accesses our website or enquires about or participates in a Service.
  • "We", "us", "our" means Pusaka Notes, based at 19 Jalan Kota Laksamana, 75200 Melaka, Malaysia.
  • "Content" means materials produced by Pusaka Notes for use in a session or course, including checklists, glossaries, correspondence logs and register books.

2. Acceptance of Terms

By submitting an enquiry, booking a session, or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our website or engage our services.

You must be at least 18 years of age and have legal capacity to enter into this Agreement. Sessions may be attended by family groups; the booking adult accepts these Terms on behalf of all participants.

3. Service Description

Pusaka Notes offers education and facilitated organisation in the field of family archive and inheritance records. Services are described on the Solutions page of our website. All Services are delivered in English and Bahasa Malaysia.

We reserve the right to decline a booking or to conclude a session early if the scope of what is requested falls outside our stated practice — for example, if a session is sought for the purpose of obtaining legal or financial advice, which we do not provide.

Services are primarily available in Melaka and nearby areas. Arrangements for delivery elsewhere are by separate agreement.

4. Scope of Practice and Limitations

Facilitation at Pusaka Notes covers document location, organisation, labelling and record-keeping. Facilitators do not:

  • Read documents for their legal or financial meaning.
  • Advise on entitlement, ownership, inheritance rights or estate administration.
  • Provide legal, financial, taxation or professional advice of any kind.
  • Act as interpreters for legal or administrative purposes.

Every substantive question of this kind is referred to an appropriately qualified professional. By booking a session, you acknowledge and accept this scope.

5. User Responsibilities

You agree to:

  • Provide accurate information when making an enquiry or booking.
  • Attend or arrange attendance at the agreed time; or give at least 48 hours notice if you need to reschedule.
  • Use Content produced for you for personal family or organisational purposes only, and not to reproduce or distribute it commercially.
  • Refrain from submitting documents, papers or information to a session for the purpose of obtaining a legal opinion or assessment.

6. Intellectual Property

All materials produced by Pusaka Notes — including checklists, glossaries, register templates and course materials — are our intellectual property. You are granted a non-exclusive licence to use them for your personal or organisational purposes. You may not reproduce or resell them without written permission.

Published sources cited in our glossaries and materials remain the property of their respective owners.

7. Payment Terms

Published prices are in Malaysian Ringgit (RM) and are inclusive of stated materials. Payment is due prior to or at the commencement of a session, unless otherwise agreed in writing.

Cancellation and rescheduling: If you cancel with less than 48 hours notice, a rescheduling fee of RM 100 applies. If you cancel with less than 24 hours notice, the full session fee is retained. For the Heritage Association Records Programme, cancellation terms are set out in the engagement letter.

Specialist conservation materials for the Heritage Association Records Programme are costed separately and agreed in writing before any materials are purchased.

8. Course Enrolment and Attendance

The Bilingual Family Register Course runs in groups of ten over five weeks. A place is confirmed upon receipt of payment. If you are unable to complete the course, we will endeavour to accommodate you in a future intake at no additional charge, subject to availability. No certificate of completion is issued; the register book itself is the record of participation.

9. Disclaimers

Services are provided for educational and organisational purposes. We make no representation as to the legal validity, completeness or admissibility of any document located, organised or labelled during a session. No session output constitutes legal advice or a legal document.

Information in our materials about administrative processes, institutions and published sources is provided for general orientation and may become outdated. We recommend verifying current procedures directly with the relevant institution.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, our liability to you in connection with any session or course is limited to the fee paid for that session or course. We are not liable for indirect, consequential or special losses, including losses arising from decisions taken on the basis of documents organised during a session.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.

11. Indemnification

You agree to indemnify and hold harmless Pusaka Notes and its facilitators from any claim, loss or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of Content produced for you.

12. Termination

Either party may terminate a session or course engagement by written notice. In such cases, we will refund a proportionate share of any fee paid for undelivered sessions, less any reasonable costs incurred. Sections 4, 6, 9, 10 and 11 survive termination.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of Malaysia. Any dispute arising under them will first be referred to informal resolution between the parties. If that does not resolve the matter within 30 days, either party may refer the dispute to the courts of Melaka, Malaysia, which shall have non-exclusive jurisdiction.

14. General Provisions

  • Entire agreement: These Terms, together with any booking confirmation, constitute the entire agreement between the parties.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
  • Waiver: Failure to enforce any provision is not a waiver of the right to do so later.
  • Assignment: You may not assign your rights under these Terms without our written consent.
  • Notices: Written notices may be sent by email to [email protected] or by post to our Melaka address.

15. Changes to These Terms

We may update these Terms from time to time. The updated date at the top of this page reflects the most recent revision. We will note material changes on the website. Continued use of our services after a revision constitutes acceptance of the updated Terms.
